On October 23, 2008, U.S. Immigration, Customs & Enforcement (a branch of the Dept. of Homeland Security) finalized the Supplemental Final Rule on No Match Letters (see the Final Rule by entering “63843” here. The rule sets out guidelines for employers who receive “no-match” letters. However, even though the rule is final, it is not actually in effect. In October, 2007 the Court granted a preliminary injunction prohibiting DHS from implementing the rule until the Court issues a final decision on the matter.
